Today we are going to discuss the potential legal ramifications of IBRs, aka, solar PV’s, massive battery storage, many wind turbines, etc ..

The topic of our current issue is Inverter Based Resources, or as we all love abbreviations, IBRs. So here we are today to discuss the potential legal ramifications of IBRs, aka, solar PV’s, massive battery storage, many wind turbines, etc
As with everything in our world, there are always legal issues that come into play with every aspect of our personal, or professional lives. So here is a rundown of the basics of what our main concerns with IBRs might be, from a lawyer’s point of view.
Here’s a clear breakdown of the main legal consequences and considerations:
Grid Interconnection & Compliance Requirements: IBRs must comply with grid codes and interconnection standards before connecting to the power system.
IEEE 1547 (U.S. DER interconnection standard), Federal Energy Regulatory Commission (FERC) Orders (e.g., Order 841 for storage, Order 2222 for distributed energy resources), Regional grid operator rules (CAISO, PJM, etc.)
Legal implications:
- Failure to comply can lead to denial of interconnection
- Utilities can disconnect non-compliant systems,
- Developers may face contract breaches or penalties
Reliability Obligations & Liability Risk: Unlike traditional generators, IBRs behave differently (less inertia, different fault responses), which can create grid stability concerns.
Legal consequences:
- If an IBR contributes to a blackout or instability event
- Operators could face liability claims
- Regulatory investigations may follow
- Compliance with mandatory reliability standards is enforced by entities like North American Electric Reliability Corporation (NERC)
- Failure to meet NERC standards can result in significant fines.
Changing Regulatory Landscape: As IBR penetration grows, regulations are evolving quickly.
Legal impact:
- Projects may need retrofits to stay compliant
- Contracts may include “change in law” clauses
- Developers risk stranded assets if rules change
Market Participation & Compensation Rules: IBRs often participate in wholesale electricity markets.
Legal considerations:
- Eligibility requirements for bidding
- Penalties for non-performance; Complex contracts for capacity, energy, and ancillary services
Cybersecurity & Data Compliance: IBRs rely heavily on digital controls and communications.
Legal exposure:
- Must comply with NERC CIP (Critical Infrastructure Protection) standards
- Data breaches or cyber incidents can trigger:
- Fines
- Legal liability
- Regulatory reporting obligations
Safety & Equipment Certification: IBRs must meet safety standards for equipment and installation.
Legal risk:
- Faulty systems can lead to: Personal injury claims, Product liability lawsuits, Insurance disputes
Environmental & Land Use Regulations: Most IBRs are renewable – but still regulated.
Legal aspects:
- Environmental review (state and federal)
- Land use/zoning approvals
- Permitting delays or litigation from local communities
Emerging Legal Issues:
Some of the newest legal concerns include:
- Grid-forming vs. grid-following requirements
- Inverter tripping events (e.g., during disturbances)
- Standardization of model validation and testing
- Responsibility for system-wide disturbances
